Phil Ivey is not giving up without a fight against against the Borgata Casino in Atlantic City despite a recent request by the casino to a federal judge for a refund of the $9.6 million he won in 2012.
According to NorthJersey.com, Ivey's attorney has now disputed Borgata's claim that Ivey's baccarat sessions in 2012 were "identical" to a 2015 case, in which Golden Nugget gamblers had to pay back the $1.5 million in winnings.
Ivey and his attorney bring up earlier judgement in the case, where a federal judge ruled that Ivey didn't violate any rules in the way he won nearly $10 million. Ivey also disagrees that he had an advantage.
"Defendants can prove that the edge sorting technique provides information for betting purposes only, and does not change the percentage of the winning hands to any extent. The Court's finding on liability does not dictate an automatic damage award," Ivey says in the brief.
